True Blue Fishing Charters – Terms & Conditions
By booking with True Blue Fishing Charters, you are entering into a binding agreement and agree to the following Terms and Conditions.
1. Bookings & Payments
- A deposit is required to confirm your booking. We do not accept tentative or unpaid bookings.
- Full payment must be made prior to departure. Any outstanding balance must be settled before the vessel leaves the dock.
- We accept payment by cash or card.
2. Cancellations & No-Shows
- Bookings cannot be cancelled by the customer. In the event you are unable to attend, you may reschedule your booking subject to the notice period set out in Section 3.
- If you do not show up or arrive after the scheduled departure time, your booking is considered forfeited.
- In such cases, you authorise True Blue Fishing Charters to charge any outstanding balance to the same card used to pay your deposit or booking.
- Any associated gift voucher will be void.
- True Blue Fishing Charters is not liable for any costs or expenses you incur due to your cancellation, non-attendance, or late arrival, including but not limited to travel, accommodation, or other related expenses.
- True Blue Fishing Charters is also not liable for any costs or expenses you incur if we cancel a charter due to weather or any other unforeseen circumstances.
3. Rescheduling Bookings
- Bookings cannot be cancelled by the customer under any circumstances.
- Bookings may only be rescheduled with the required notice, or in the event that True Blue Fishing Charters cancels the trip for any reason (e.g., weather, low numbers, or any other unforeseen circumstances).
- Required notice periods to reschedule are as follows:
- Shared charters: Minimum 7 days’ notice
- Private charters: Minimum 14 days’ notice
- Rescheduling is subject to availability and operational requirements.
- If the required notice is not provided, your booking and any payment or voucher used will be forfeited.
- In such cases, you authorise True Blue Fishing Charters to charge any outstanding balance to the same card used for your deposit or booking payment.
4. Gift Vouchers
- Voucher numbers must be provided at the time of booking. They will not be accepted after the fact.
- Vouchers are valid for 3 years from the date of issue and cannot be extended.
- Gift vouchers are non-refundable and not redeemable for cash under any circumstances.
- If your charter is cancelled by True Blue Fishing Charters due to weather, low numbers, or any other unforeseen circumstances, your voucher will remain valid for use on another date. The voucher remains valid for a reschedule only until its expiry date.
5. Refunds
- Refunds are only available if the charter is cancelled by True Blue Fishing Charters (e.g., due to unsafe weather, low numbers, or any other unforeseen circumstances).
- If you booked directly with True Blue Fishing Charters, please contact us directly to arrange your refund.
- If you booked through a third-party agent, you will need to contact them to obtain a refund. The agent will then seek confirmation of cancellation from us. Once approved, a refund will be authorised.
- If a charter begins but must return early (e.g., due to weather or other unforeseen circumstances), a partial refund may apply, calculated on a pro rata basis.
- By proceeding with your booking, you authorise True Blue Fishing Charters to charge any outstanding balances to the card used at the time of booking, where applicable.
6. Charter Conditions
- All charters are subject to minimum and maximum passenger numbers.
- Children under 14 must be supervised by a parent or guardian at all times.
- Our shared charters are not recommended for children under 7 years old.
- No refunds will be issued due to seasickness.
- Customers are responsible for the cost of any lost or damaged fishing equipment due to negligence.
- These terms apply to all bookings, whether made directly or via an agent.
7. Safety, Weather & Liability
- Charters proceed in the rain. However, strong winds, large swell, or other unsafe conditions may result in cancellation for safety reasons.
- The decision to cancel a charter due to weather or any other unforeseen circumstances can only be made by the vessel skipper or the business owner.
- If True Blue Fishing Charters cancels your booking due to weather, low numbers, or any other unforeseen circumstances, you may:
- Reschedule your booking, or
- Receive a full refund if the charter did not operate.
- If the vessel returns early during a charter, partial refunds may be given on a pro rata basis.
- Weather and safety conditions can change quickly. You will be notified via text, phone, or email of any cancellations. Please keep your phone switched on.
- True Blue Fishing Charters is not liable for any out-of-pocket expenses you may incur due to cancellations, reschedules, or delays, including but not limited to travel and accommodation costs.
8. Alcohol, Drugs, Smoking & Behaviour
- Guests may bring beer (in cans) and wine for consumption onboard. No glass bottles or spirits are allowed.
- Alcohol must be consumed in moderation. The skipper reserves the right to restrict or stop alcohol consumption at any time to maintain a safe environment.
- Illicit drugs, including medicinal marijuana, are strictly prohibited onboard at all times.
- Smoking and vaping are prohibited on shared charters. On private charters, smoking and vaping are permitted only in a designated area and only if there are no objections from others in the group.
- Any guest found in possession of or under the influence of illicit substances will be denied boarding or removed from the vessel. No refunds will be issued.
- Unruly, unsafe, or intoxicated behaviour may result in early termination of the charter without refund. You may also be held liable for compensation to other affected passengers.
